IN NO EVENT WILL OUR AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) AT ISSUE.

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless KAIDO Motors and its affiliates, officers, employees, agents, and partners from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from Your use of the site or violation of this Agreement or third-party rights.

FORCE MAJEURE

We are not responsible for delays or failures caused by events beyond our reasonable control (including acts of God, natural disasters, labor disputes, power failures, internet disturbances, governmental actions).

RETURNS / STORE CREDIT

Returns and refunds are governed by our Refund Policy: [Link to Refund/Returns Policy]. We currently serve U.S. customers only; international orders are not accepted for returns.

SWEEPSTAKES & PROMOTIONS

Sweepstakes, giveaways, or promotions are governed by their official rules, which will control in the event of a conflict with this Agreement. We may disqualify entries for fraud, ineligible accounts, or violation of rules. Household/IP limits and eligibility checks may apply.

PROHIBITED CONDUCT

You may not:

Use the site for unlawful purposes or to violate rights of others;
Upload malware or attempt to circumvent security;
Scrape, crawl, or harvest data without authorization;
Submit fraudulent orders or entries;
Infringe intellectual property rights.

We may suspend or terminate accounts violating these terms.

ASSIGNMENT

You may not assign or transfer this Agreement without our prior written consent. We may assign or delegate our rights or obligations without notice.

DISPUTES; GOVERNING LAW; VENUE; JURY WAIVER

Before filing any action, You agree to first email kaidomotors01@gmail.com to attempt good-faith resolution. This Agreement and Your use of the site are governed by the laws of the State of Oklahoma. Exclusive venue lies in the state or federal courts located in Oklahoma County, Oklahoma. YOU WAIVE ANY RIGHT TO A TRIAL BY JURY to the extent permitted by law.

SEVERABILITY

If any provision is held invalid or unenforceable, the remaining provisions will continue in full force and effect, and a valid term that best reflects the original intent will be substituted.

HEADINGS

Headings are for convenience only and do not affect interpretation.

ENTIRE AGREEMENT

This Agreement, together with incorporated policies (Privacy Policy, Refund Policy, Sweepstakes Rules), is the entire understanding between You and KAIDO Motors and supersedes prior agreements.

AGREEMENT UPDATES

We may update this Agreement from time to time. Material changes will be posted with an updated “Effective Date.” Continued use of the site after changes constitutes acceptance.
